1. The Service

Rufus is a video creation app for macOS that helps you find clips, generate captions, create ads, campaigns, animations and music clips, and publish to connected social networks. Most processing happens on your Mac. Some features depend on third-party tools and services that you install or connect, such as ffmpeg, Whisper, yt-dlp, Node.js, HyperFrames, AI providers and social networks.

We may change, add or remove features to improve the Service, fix problems or meet legal or partner requirements.

2. Eligibility and account

• You must have legal capacity to enter into a contract. People under 18 may use the Service only with the supervision and consent of their legal guardians.
• The app requires macOS 14 or later on a Mac with Apple Silicon.
• Account information must be accurate and kept up to date. You are responsible for the security of your email and access codes and for all activity on your account.
• Tell us immediately if you suspect unauthorized use of your account.

3. App license

We grant you a personal, limited, revocable, non-exclusive and non-transferable license to install and use Rufus on Macs you control, within the limits of your plan. The software is licensed, not sold.

You may not: copy, resell, sublicense or distribute the app; bypass, disable or circumvent license validation, computer limits or other technical protections; reverse engineer the app except where the law expressly allows it; or use the Service to build a competing product.

4. Plans, payments and cancellation

• Free plan: includes the basic features described on the website at no cost and may have usage limits.
• Pro plan: a monthly or yearly subscription that unlocks additional features. Price, currency and period are shown at checkout.
• Payments are processed by Stripe. The subscription renews automatically at the end of each period at the current price until you cancel it.
• You can cancel at any time from the billing portal on the Account page. Cancellation stops future renewals, and Pro access continues until the end of the period already paid.
• Right of withdrawal: consumers in Brazil may withdraw from their first purchase within 7 days for a full refund, under article 49 of the Consumer Protection Code. Consumers in other jurisdictions keep any mandatory withdrawal rights under their local law. Otherwise, periods that have already started are not refunded unless the law requires it.
• We may change prices. You will be notified in advance, and the new price applies only from the next renewal.
• If a payment fails, Pro features may be suspended until it is resolved.

5. Computer activation

The Pro plan is validated per account and per activated computer. You can release a Mac on the Account page to activate another one. To support offline use, a license that has already been validated may keep working for a limited period until it expires and needs to be validated again.

6. Your content

You keep all rights to the videos, audio, images, text and other materials you use or create with Rufus (“Your Content”). AERES claims no ownership of Your Content and does not receive it, since it is processed on your Mac.

You are solely responsible for Your Content and confirm that you hold all rights, licenses and permissions needed to use, edit and publish it, including copyright, the image and voice rights of people shown, music and trademarks.

7. Acceptable use

You agree not to use the Service to:

• break the law, infringe third-party rights or violate the terms of the platforms where you publish;
• download or reuse videos without permission from the rights holder;
• create or share content that is illegal, defamatory, discriminatory, hateful, violent, sexual involving minors or that encourages harm;
• produce deepfakes, impersonate others or mislead the public about where content comes from;
• run misleading or abusive advertising or make unsubstantiated claims in ads;
• distribute malware, send spam or interfere with the security and operation of the Service.

8. Artificial intelligence

Suggested clips, titles, hooks, notes, scripts, ads and other AI-generated results may contain errors, inaccuracies or similarities to existing material. Review every result before you use or publish it. You are responsible for decisions based on these results and for what you publish.

AERES does not guarantee the performance, reach, views, sales or virality of any content.

9. Third-party services

Use of AI providers, cloud rendering, social networks and external tools is subject to those third parties’ terms, policies and prices. Subscriptions, credits and calls to these services are billed by them, not by AERES. We are not responsible for third-party outages, changes, limits, app reviews, account suspensions or charges.

10. AERES intellectual property

The app, the website, the Rufus and AERES brands, the mascot, animation templates, interfaces and other AERES materials are protected by law. Apart from the license in these Terms, no rights are transferred to you. Open-source components included in the app are subject to their own licenses.

If you send us suggestions or feedback, we may use them freely to improve the Service without any obligation to compensate you.

11. Availability and updates

We aim to keep the Service available and working, but it is provided “as is” and may experience interruptions, maintenance and failures. Updates may be required to keep using some features. The app is not yet notarized by Apple, and macOS may ask for confirmation the first time you open it. Keep backups of your files.

12. Limitation of liability

To the maximum extent permitted by law, AERES is not liable for indirect damages, lost profits, loss of data or content, lost opportunities, or damages arising from third-party services, Your Content or misuse of the Service. Where liability exists, it is limited to the amount you paid AERES in the 12 months before the event.

Nothing in these Terms excludes consumer rights that cannot be limited by contract, or liability for willful misconduct or gross negligence.

13. Suspension and termination

You can stop using the Service and close your account at any time. We may suspend or terminate access in case of breach of these Terms, fraud, non-payment, security risk or legal requirement, notifying you when possible. Provisions that by their nature should survive remain in effect after termination.

14. Changes to these Terms

We may update these Terms. The last updated date appears at the top of this page. Material changes will be announced with reasonable notice on the website, in the app or by email. By continuing to use the Service after the changes take effect, you accept the new version.

15. Governing law and jurisdiction

These Terms are governed by the laws of the Federative Republic of Brazil. Where the Brazilian Consumer Protection Code applies, disputes will be settled in the courts of the consumer’s domicile; otherwise, in the courts of AERES’s headquarters. Mandatory consumer protections of your country of residence still apply. Before taking any action, please contact our support so we can try to resolve the matter amicably.

The Portuguese version prevails over translations in case of any discrepancy.
